Secret Flying – Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “user”, or “member”) and Secret Flying Corp (“Secret Flying”, “we”, “us”, or “our”) governing your access to and use of the Secret Flying website, platform, membership services, and any related features, content, or services (collectively, the “Service”).

By accessing, browsing, creating an account, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service.

1. Overview of the Service

Secret Flying operates a digital travel discovery platform designed to help users identify and access discounted flight opportunities, travel deals, and related travel content.

The Service includes, but is not limited to:

  • Curated flight deal listings

  • Personalised deal alerts and notifications

  • Travel-related editorial content and guides

  • Membership features and user account functionality

  • Platform tools designed to assist users in discovering travel opportunities

Secret Flying acts solely as an informational service provider.

We do not:

  • Sell airline tickets

  • Act as a travel agency

  • Process travel bookings

  • Guarantee availability, pricing, or accuracy of third-party offers

All travel bookings are made directly between you and third-party travel providers. Any contractual relationship formed is solely between you and the relevant third party.

Secret Flying accepts no responsibility for bookings, transactions, cancellations, pricing changes, errors, or disputes arising from third-party providers.

2. Eligibility and Account Registration

To access certain features of the Service, you may be required to create an account.

By creating an account, you represent and warrant that:

  • You have the legal capacity to enter into binding agreements

  • All information provided is accurate, current, and complete

  • You will maintain and promptly update your account information

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Membership Plans

Secret Flying currently provides free membership access.

We may introduce paid membership plans in the future that offer additional features, enhanced functionality, or premium content (the “Paid Membership”).

Participation in any Paid Membership will be optional.

All pricing, billing frequency, features, and applicable terms will be clearly disclosed prior to purchase.

We reserve the right to modify, add, or remove membership features at any time.

4. Future Payments and Merchant of Record

When Paid Memberships are introduced, payments will be processed by our Merchant of Record, Paddle.

Paddle will act as the authorized merchant responsible for:

  • Processing payments

  • Managing billing and subscription renewals

  • Collecting and remitting applicable taxes

  • Administering payment-related matters in accordance with applicable laws and policies

When you purchase a Paid Membership, Paddle will appear as the merchant on your billing statement.

Your purchase may also be subject to Paddle’s terms and policies.

5. Future Subscription Billing and Renewal

When Paid Memberships become available, subscriptions will automatically renew at the selected billing interval unless cancelled prior to renewal.

By purchasing a Paid Membership, you will authorize recurring charges using your selected payment method.

Full billing details, including pricing and billing frequency, will be disclosed prior to purchase. Changes to your subscription plan, including upgrades, downgrades, or cancellations, must be made prior to the final 30 minutes of the current billing period. Requests submitted within the final 30 minutes of a billing period may not be processed until the next billing cycle, and the renewal may proceed based on the subscription settings in effect at that time.

You may cancel your subscription at any time, excluding the final 30 minutes of the current billing period, and cancellation will take effect at the end of the current billing period unless otherwise specified.

6. Refunds and Cancellation

Refund eligibility, if applicable, will be clearly disclosed prior to purchase of any Paid Membership.

Unless required by applicable law, all subscription payments are final and non-refundable. This includes partially used subscription periods and situations where a member has accessed any portion of the Paid Membership features or content.

You may cancel your subscription at any time through your account or designated billing portal. Cancellation will stop future renewals, but will not entitle you to a refund for any current billing period already paid.

7. Third-Party Websites and Services

The Service contains links to third-party websites, products, and services.

These links are provided for informational purposes only.

Secret Flying does not control, endorse, or assume responsibility for:

  • Third-party content

  • Pricing accuracy

  • Availability of offers

  • Booking processes

  • Terms or policies of third parties

You access third-party services entirely at your own risk.

Any disputes must be resolved directly with the third-party provider.

8. Accuracy of Information and No Guarantees

While we strive to provide accurate and timely information, Secret Flying makes no warranties or representations regarding:

  • Accuracy of deal information

  • Continued availability of deals

  • Pricing validity

  • Suitability of deals for any particular purpose

Travel pricing and availability are controlled entirely by third parties and may change at any time.

Secret Flying shall not be held liable for any losses resulting from reliance on information provided through the Service.

9. Acceptable Use

You agree not to:

  • Use the Service for unlawful or fraudulent purposes

  • Interfere with or disrupt the Service

  • Attempt to gain unauthorized access to any portion of the Service

  • Copy, scrape, or exploit content without authorization

  • Reverse engineer, reproduce, or redistribute Service content without permission

We reserve the right to restrict or terminate access for violations of these Terms.

10. Intellectual Property

All content, features, design, branding, and functionality of the Service are owned by Secret Flying or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

You may not reproduce, distribute, or create derivative works without prior written consent.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

Secret Flying disclaims all warranties, express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Availability or uninterrupted operation

We do not guarantee that the Service will be error-free or continuously available.

12. Limitation of Liability

To the maximum extent permitted by law, Secret Flying shall not be liable for any:

  • Indirect, incidental, or consequential damages

  • Loss of profits, revenue, or data

  • Travel-related losses

  • Booking issues with third parties

Our total liability shall not exceed the amount paid by you, if any, for use of the Service in the preceding twelve months.

13. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, including for violations of these Terms.

Termination does not relieve you of obligations incurred prior to termination.

14. Communications and Notifications

Where applicable, you may opt out of receiving flight deal alerts or other marketing communications. However, even if you opt out of such communications, you acknowledge and agree that we may continue to send you non-promotional, service-related communications, including, without limitation, emails relating to your account, security matters, billing and payment processing, and updates or changes to your membership or the Service.

You are responsible for ensuring that your contact information is accurate and up to date so that you can receive important service-related communications.

15. Modifications to the Service

We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time.

We shall not be liable for any modification or discontinuation.

16. Changes to These Terms

We may revise these Terms from time to time.

Updated Terms will be posted on this page.

Continued use of the Service constitutes acceptance of revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Panama.
